The workshop will discuss new insights in the interaction between logic and law, and more precisely the study of different answers to the question: What role does logic play in legal reasoning? It will present both current challenges and historical perspectives in the relation between logic and law. The perspectives to be discussed involve the interface of the following studies.

This book employs Heidegger’s work of the 1920s and early 1930s to develop distinctively Heideggerian accounts of agency, freedom, and responsibility, making the case that Heidegger’s thought provides a compelling alternative to the mainstream philosophical accounts of these concepts.

Prominent advocates of posthumanism such as Nick Bostrom and Ray Kurzweil make the case that a drastic increase in the human lifespan would be intrinsically good. This question of the value of an extended lifespan has perhaps become more pressing as medical and scientific advances are seemingly bringing us closer and closer to being able to extend our lives in the way posthumanists envision. In this paper I intend to use Martin Heidegger’s work on death and freedom to develop a (...) potential objection to the claim that an indefinite healthspan is intrinsically desirable. The basic plan will be to make the case that the structure of human agency is such that truly free action is possible only on the basis of the essential finitude of our existence. Assuming that we take this sort freedom to be an important good, we would lose something of crucial importance if we were to radically extend the human healthspan. I am not claiming to present an entirely conclusive argument against posthumanism, or even enhancing the human healthspan to posthuman proportions, but rather, I see my argument here as adding another currently valued dimension of human existence that could very well be lost if we move decisively in the posthumanist direction. Artificial intelligence receives attention in media as well as in academe and business. In media coverage and reporting, AI is predominantly described in contrasted terms, either as the ultimate solution to all human problems or the ultimate threat to all human existence. In academe, the focus of computer scientists is on developing systems that function, whereas philosophy scholars theorize about the implications of this functionality for human life. In the interface between technology and philosophy there is, however, one imperative aspect (...) of AI yet to be articulated: how do intelligent systems make inferences? We use the overarching concept “Artificial Intelligent Behaviour” which would include both cognition/processing and judgment/behaviour. We argue that due to the complexity and opacity of artificial inference, one needs to initiate systematic empirical studies of artificial intelligent behavior similar to what has previously been done to study human cognition, judgment and decision making. This will provide valid knowledge, outside of what current computer science methods can offer, about the judgments and decisions made by intelligent systems. Moreover, outside academe—in the public as well as the private sector—expertise in epistemology, critical thinking and reasoning are crucial to ensure human oversight of the artificial intelligent judgments and decisions that are made, because only competent human insight into AI-inference processes will ensure accountability. Such insights require systematic studies of AI-behaviour founded on the natural sciences and philosophy, as well as the employment of methodologies from the cognitive and behavioral sciences. Wenn etwa Alfred Grosser in seiner Rede den Bogen zu seiner eigenen Biografie hin zu den Banlieues unserer Tage in Paris spannt. "Ich bin seit 1937 Franzose, unsere Erziehungsministerin ist Franzosin seit 1995, unser Premierminister seit 1982, die Burgermeisterin von (...) Paris seit 1973, Nicolas Sarkozy ist Fluchtlingssohn. Niemand wird sagen, sie sind nicht Franzosen. Aber die jungen Leute in den sogenannten "Vororten" sind fast alle franzosische Staatsburger und werden total diskriminiert. To this end, the four main sections of the volume deal with the question of authenticity, id est what it means to be (...) an authentic person, the ways in which the phenomenological and existential traditions can impact the sciences, how best to understand the fact of human mortality, and, finally, the ways philosophical reflection can help address current questions of value. The volume is designed primarily to serve as a secondary resource for students and specialists interested in rediscovering the practical application of existential and phenomenological thought. The collection of scholarly essays, then, could be used in conjunction with some of the more recent scholarship concerning the practical value of philosophy. In this analysis we discuss the change in criteria for triage of patients during three different phases of a pandemic like COVID-19, seen from the critical care point of view. Availability of critical care beds has become a hot topic, and in many countries, we have seen a huge increase in the provision of temporary intensive care bed capacity. However, there is a limit where the hospitals may run out of resources to provide critical care, which is heavily dependent on (...) trained staff, just-in-time supply chains for clinical consumables and drugs and advanced equipment. In the first phase, we can still do clinical prioritisation and decision-making as usual, based on the need for intensive care and prognostication: what are the odds for a good result with regard to survival and quality of life. In the next, the resources are mostly available, but the system is stressed by many patients arriving over a short time period and auxiliary beds in different places in the hospital being used. We may have to abandon admittance of patients with doubtful prognosis. In the last phase, usual medical triage and priority setting may not be sufficient to decrease inflow and there may not be enough intensive care unit beds available. In this phase different criteria must be applied using a utilitarian approach for triage. We argue that this is an important transition where society, and not physicians, must provide guidance to support triage that is no longer based on medical priorities alone. (shrink)

Hegel’s mature system, because of its division into three parts, makes particularly high demands on the argumentative powers when it comes to the demonstration of the necessity of the links between the respective parts of the system. It is a well known fact that the transition from/of logic to natural philosophy is a very critical point in the system, and was already subjected to particular criticism by Schelling as being a weak point in the system. For Hegel, however, the transition (...) from natural philosophy to the philosophy of spirit is also such a critical seam or hinge in his system. The three versions of the Encyclopedia of the Philosophical Sciences provide documentary evidence of his continuous work on the relevant passages. Hegel’s own handwritten notes and drafts, and also the students’ manuscripts of his lectures on “subjective spirit”, provide interpreters with additional information and thus give them more profound insights into Hegel’s efforts to achieve conceptual precision in this area, as well as into an abundance of empirical material that Hegel gathered and subsequently incorporated from contemporary science as it developed. An ethics reflection group is one of a range of ethics support services developed to better handle ethical challenges in healthcare. The aim of this article is to evaluate the implementation process of interdisciplinary ERGs in psychiatric and general hospital departments in Denmark. To our knowledge, this is the first study of ERG implementation to include both psychiatric and general hospital departments. The implementation and evaluation strategies are inspired by action research, using a qualitative approach and systematic text condensation of (...) 28 individual interviews and 4 focus groups with clinicians, ethics facilitators and ward managers. The implementation process was influenced by both structural factors and factors related to clinicians having different values, interests and experiences. Structural barriers and promotors in the process to implement ERG included the following sub-categories: Organizational factors, recruitment and training of ethics facilitators, the deliberation model, planning and recruitment of participants to the ERGs, the support of the ward managers and the project group. Barriers and promotors found among clinicians included the following sub-categories: Expectations and pre-understandings of ERGs, understandings of a physician’s job, challenges experienced by ethics facilitators. At the end of the study, when it was decided that the ERGs should be continued, the implementation strategies were remodeled by the participants to meet new challenges. The study of ERG implementation identified important structural and professional barriers and promotors that are likely to be relevant to anyone wanting to implement ethics support services across various types of healthcare services. Embryonic development and adult tissue homeostasis are controlled through activation of intracellular signal transduction pathways by extracellular growth factors. In the past, signal transduction has largely been regarded as a linear process. However, more recent data from large‐scale and high‐throughput experiments indicate that there is extensive cross‐talk between individual signaling cascades leading to the notion of a signaling network. The behavior of such complex networks cannot be predicted by simple intuitive approaches but requires sophisticated models and computational simulations. The purpose (...) of such models is to generate experimentally testable hypotheses and to find explanations for unexpected experimental results. Pluralistic ignorance is a socio-psychological phenomenon that involves a systematic discrepancy between people’s private beliefs and public behavior in certain social contexts. Recently, pluralistic ignorance has gained increased attention in formal and social epistemology. But to get clear on what precisely a formal and social epistemological account of pluralistic ignorance should look like, we need answers to at least the following two questions: What exactly is the phenomenon of pluralistic ignorance? And can the phenomenon arise among perfectly rational agents? In (...) this paper, we propose answers to both these questions. First, we characterize different versions of pluralistic ignorance and define the version that we claim most adequately captures the examples cited as paradigmatic cases of pluralistic ignorance in the literature. In doing so, we will stress certain key epistemic and social interactive aspects of the phenomenon. Second, given our characterization of pluralistic ignorance, we argue that the phenomenon can indeed arise in groups of perfectly rational agents. This, in turn, ensures that the tools of formal epistemology can be fully utilized to reason about pluralistic ignorance. (shrink)

In this paper we explore the potential bearing of the extended mind thesis—the thesis that the mind extends into the world—on epistemology. We do three things. First, we argue that the combination of the extended mind thesis and reliabilism about knowledge entails that ordinary subjects can easily come to enjoy various forms of restricted omniscience. Second, we discuss the conceptual foundations of the extended mind and knowledge debate. We suggest that the theses of extended mind and extended knowledge lead to (...) a bifurcation with respect to the concepts of belief and knowledge. We suggest that this conceptual bifurcation supports a form of pluralism about these concepts. Third, we discuss whether something similar can be said at the metaphysical level. (shrink)
